1. Definitions
Tenant / Renter: The individual(s) or entity renting the property.
Owner / Landlord: The legal owner of the property.
Agent: Love & Mercy Travel Sdn Bhd, acting as an intermediary between the Tenant and the Owner.
Property: The residential unit, apartment, or house being rented.
2. Rental Agreement
A formal rental agreement must be executed by both the Tenant and the Owner, facilitated by the Agent. The agreement shall specify the rental period, rental amount, deposits, and all applicable terms and conditions.
3. Rental Duration
Short-Term Rental: Less than six (6) months.
Long-Term Rental: Six (6) months or more.
4. Payment Terms
Security Deposit: Equivalent to two (2) months’ rental, refundable subject to property condition.
Utility Deposit: Equivalent to one (1) month’s rental, refundable after settlement of all utility charges.
Advance Rental: One (1) month’s rental payable in advance.
Payment Method: Bank transfer or other approved methods payable to the Owner or Agent as stated in the invoice.
5. Tenant Responsibilities
- Maintain the property in a clean and good condition throughout the tenancy.
- Settle all utility and service charges during the rental period.
- Promptly notify the Agent or Owner of any damage or required repairs.
- No subletting, assignment, or sharing without written consent from the Owner.
6. Owner Responsibilities
- Ensure the property is fit for occupation at the commencement of tenancy.
- Attend to normal wear-and-tear maintenance within a reasonable timeframe.
- Provide valid ownership and utility documentation upon request.
7. Termination of Lease
Short-Term Rental: Thirty (30) days’ written notice by either party.
Long-Term Rental: Sixty (60) days’ written notice is required. Early termination may result in forfeiture of deposits, subject to the agreement.
8. House Rules
- No illegal activities or conduct causing nuisance to neighbours.
- Pets are only permitted with prior written approval from the Owner.
- Smoking inside the premises is subject to Owner’s rules.
9. Agent’s Role
- Coordinate and facilitate the rental process.
- Collect and disburse payments as authorised.
- Assist in dispute resolution in a neutral and professional manner.
10. Governing Law
These terms shall be governed and construed in accordance with the laws of Malaysia. Any dispute shall be resolved through mediation or Malaysian courts.
11. Documents to be Prepared
Tenant:
- Copy of NRIC (Malaysians) or passport (foreigners).
- Proof of income or financial capability.
- Employment letter or student verification (if applicable).
Owner:
- Copy of NRIC.
- Proof of property ownership.
- Latest utility and maintenance statements.
Agent:
- Owner’s letter of authorisation.
- Standard tenancy agreement template.
- Inventory checklist for furnished units.
12. Additional Provisions
- Pre- and post-tenancy inspections will be conducted where applicable.
- Clear communication among all parties is encouraged to ensure smooth tenancy.
